We collect information about you, as you use any of our apps, websites or any other software. This information is used for marketing purposes, as permitted by law. We do not sell your personal information.

Web privacy policy

We take your privacy seriously, and we want you to know how we collect, use, share and protect your information. In addition to this privacy policy, users of the PatientGain site should consult the PatientGain site terms of use as well as any product specific terms and conditions that apply. What information we collect

By using any of our websites, apps, software tools, and sending us your information, you are giving us permission to contact you by electronic and non-electronic means. We also track the conversions and collect user data to improve marketing.

We respect the right to privacy of all visitors to the  PatientGain site. We do not collect information that would personally identify you unless you choose to provide it. For example, if you choose to request an appointment or join the newsletter, the privacy policy and terms of use of that site apply. The personal information that you submit, such as on the appointment request form, is shared only with those people in PatientGain who need this information to respond to your question or request and those internal areas that will utilize the information to improve PatientGain operations. Information submitted through online forms may be collected to ensure technical functionality. It will also be utilized to address any inappropriate use of our website. We do not sell it to any other organizations.

Email communications, newsletter and related services

PatientGain provides you with the opportunity to receive communications from us. You can sign up for a free email newsletter. You can unsubscribe from this newsletter at any time.

Email communications that you send to us via the email links on our site may be shared with a customer service representative, employee, marketing expert or agent that is most able to address your inquiry. We make every effort to respond in a timely fashion once communications are received. Once we have responded to your communication, it is discarded or archived, depending on the nature of the inquiry.

The email functionality on our site does not provide a completely secure and confidential means of communication. It’s possible that your email communication may be accessed or viewed by another Internet user while in transit to us. If you wish to keep your communication private, do not use our email.

You may decide at some point that you no longer wish to receive communications from our site. To stop receiving communications, send an email message to billing@patientgain.com or send regular mail to the postal address.

Surveys

We occasionally survey visitors to our site. The information from these surveys is used in aggregated, de-identified form to help us understand the needs of our visitors so that we can improve our site. The information may be shared with third parties with whom we have a business relationship. We generally may ask for information in surveys that would personally identify you; if we do request contact information for follow-up, you may decline to provide it. If survey respondents provide personal information (such as an email address) in a survey, it is shared only with those people who need to see it to respond to the question or request, or with third parties who perform data management services for our site. Those third parties have agreed to keep all data from surveys confidential.

IP addresses

The Web server automatically collects the Internet Protocol (IP) address of the computers that access our site. An IP address is a number that is assigned to your computer when you access the Internet. It is not truly personally identifiable information because many different individuals can access the Internet via the same computer. We use this information in aggregate form to understand how our site or advertisements from PatientGain are being used and how we can better serve visitors.

Cookies and other tracking technology

We collect information about visitors to our site using “cookies” and similar technology such as Web beacons, Web bugs, pixel tags, and so on. We use this technology to recognize a repeat visitor and offer the visitor a set of services or information requested in a previous visit. We use session cookies to track a visitor’s path through our site during a visit, to help us understand how people use our site.

Processing any orders, tickets, servicing a customer or a prospect customer

We will retain your information for as long as your account is active or inactive or as needed to provide you services, comply with our legal obligations, resolve disputes, and enforce our agreements.

Except for authorized law enforcement investigations or other valid legal processes. However we do not sell any personally identifiable information we receive from you.

We may share some information to third parties

We may share your personally identifiable information with third parties who we have engaged to help us provide the services. In each case, we will ensure that these third parties have agreed not to use or disclose your personal information except to help us provide the services. We may provide third parties with aggregate statistics about our visitors, traffic patterns and related site information. These data reflect site-usage patterns gathered during visits to our website each month, but they do not contain behavioral or identifying information about any individual member unless that member has given us permission to share that information.

To help us determine the effectiveness of PatientGain advertising, we work with Web analytics tools hosted by third parties who receive nonidentifiable information from your browser, including but not limited to the site or the advertisement you came from, your IP address, your general geographic location, your browser and platform information, and the pages you view within our site.

Ads by Google and other ad agencies

Note that Google and other companies, like Facebook, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our site users based on their visit to our site and other sites on the Internet. No personally identifiable information is collected as part of Google’s process. Users may opt out of the use of this DART cookie by visiting Google’s privacy document.

If you would like more information about these practices and to know your choices about not having this information used by these companies, visit the Network Advertising Initiative. Some ad servers allow you to opt out of anonymous data collection through the use of cookies. To do so, you must opt-out of such data collection with each individual site. Protecting your privacy

Whether you are visiting the PatientGain site or in one of our clinic/practice/customer locations, we use reasonable security measures to protect the confidentiality of personal information under our control and appropriately limit access to it. We use a variety of information security measures to protect your online transactions with us. The  PatientGain site uses encryption technology, such as Secure Sockets Layer (SSL), to protect your personal information during data transport. SSL protects information you submit via our website, such as ordering information including your name, address and credit card number. That being said, PatientGain cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. We have taken reasonable steps to ensure the integrity and confidentiality of personally identifiable information that you may provide. You should understand, however, that electronic transmissions via the Internet are not necessarily secure from interception, and so we cannot absolutely guarantee the security or confidentiality of such transmissions.

This Privacy Notice for California Residents supplements the information contained in any other Privacy Statement or Notice provided by The PatientGain.com Inc and its affiliates (“PatientGain.com” or “we”) and applies solely to residents of the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”), as amended, and any terms defined in the CCPA have the same meaning when used in this notice. 

By using any of our websites, apps, software tools, and sending us your information, you are giving us permission to contact you by electronic and non-electronic means. We also track the conversions and collect user data to improve marketing.

Please note that certain exemptions apply to your rights and PatientGain.com obligations pursuant to the CCPA. These rights and requirements may not apply in certain situations depending on your relationship with PatientGain.com, PatientGain.com’ other legal obligations, and as otherwise provided for in the CCPA.

PatientGain.com reserves the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the PatientGain.com website and update the notice’s effective date. Your continued use of our services, products, websites following the posting of changes constitutes your acceptance of such changes.

INFORMATION WE COLLECT

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, we may have collected the following categories of personal information from our consumers within the last twelve (12) months:

  • Identifiers – A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver’s license number, passport number, signature or other similar identifiers.

  • Biometric information – Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.
  • Commercial information – Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies,
  • Internet or other similar network activity – Browsing history, search history, information on a consumer’s interaction with a website, application or advertisement.
  • Geolocation data – Physical location or movements.
  • Sensory data – Audio, electronic, visual, thermal, olfactory, or similar information.
  • Professional or employment-related information – Current or past job history or performance evaluations.
  • Inferences drawn from other personal information – Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
  • Household Information – Information pertaining to household age, estimated income identifier, number of persons in household, number of cars owned, household college education, dwelling type, among other information capable of being linked to a household.

WHERE WE COLLECT YOUR PERSONAL INFORMATION FROM

We will collect the personal information described above from one or more of the below sources:

  • directly from you throughout our relationship, including when you sign up for, and/or use, our products, services and websites, or when you visit our offices or attend a PatientGain.com event;
  • indirectly from you, for example, from observing your actions on our websites or mobile apps;
  • from our affiliates, subsidiaries and partners;
  • from third parties that are authorized to share your information with us, such as our institutional clients and service providers; and
  • from publicly available sources of information.

USE OF PERSONAL INFORMATION

We may use or disclose the personal information we collect for one or more of the following business purposes:

PatientGain.com will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

DISCLOSURES OF PERSONAL INFORMATION FOR A BUSINESS PURPOSE

In the preceding twelve (12) months, PatientGain.com has disclosed the following categories of personal information for a business purpose:

  • Protected classification characteristics under California or federal law.
  • Biometric information.
  • Internet or other similar network activity.

  • Commercial information
  • Sensory data.

We disclose your personal information for a business purpose to the following categories of third parties:

  • PatientGain.com entities, affiliates and subsidiaries;
  • Business partners;
  • Service providers who help manage, develop, and analyse our business and/or deliver services to us and our clients. These service providers have agreed to confidentiality restrictions and use any personal information we share with them or which they collect on our behalf solely for the purpose of providing the contracted service to us;
  • Agencies and organizations working to prevent fraud in financial services;
  • Law enforcement, regulatory and other governmental agencies;
  • Advertisers and Social Media Companies, subject to their data privacy policies and your consent for such processing,
  • Any potential or actual third party purchasers of PatientGain.com assets where consumer information may be among those assets transferred.

NO SALE OF PERSONAL INFORMATION

PatientGain.com has not sold personal information in the preceding twelve (12) months. To the extent that PatientGain.com ever changed its policy and chose to sell personal information, you would have the right to opt-out of the sale of your personal information. We do not sell your personal information.

Children’s Online Privacy

Our website is a general audience site and is not intended for use by children under 18. We do not knowingly collect personal information from children under the age of 18 through our website. If you become aware that a child under 18 has provided us with personal information through our website, we expect that you notify us by email at privacy@patientgain.com Should we become aware that a child under age 18 has provided personal information through the website, we will take steps to immediately delete it.

Access to Specific Information Rights

You have the right, subject to certain exceptions defined in the CCPA and other applicable laws and regulations, to request that PatientGain.com disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The categories of personal information that each recipient received.
  • The specific pieces of personal information we collected about you.

DELETION REQUEST RIGHTS

You have the right, subject to certain exceptions defined in the CCPA and other applicable laws and regulations, to request that PatientGain.com delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request we will delete (and direct our service providers to delete) your personal information from our records.

EXERCISING ACCESS AND DELETION RIGHTS

To exercise the access, and deletion rights described above, please submit a verifiable consumer request to us by either:

You may only make a verifiable consumer request for access twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to verify, to a reasonably high degree of certainty, that you are the person about whom we collected personal information. This may include requesting that you provide us with at least two or more pieces of personal information to match against personal information about you that we may or may not maintain and which we have determined to be reliable for the purpose of verification.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request as per CCPA guidelines. 

AUTHORIZED AGENT

Only you, or a person you have designated in writing as your authorized agent, or whom is registered with the California Secretary of State to act on your behalf, or whom you have provided power of attorney pursuant to California Probate Code sections 4000 to 4465, (“Authorized Agent”), may make a verifiable consumer request related to your personal information to  privacy@patientgain.com

If you wish to have an Authorized Agent make a verifiable consumer requests on your behalf, they will need to provide us with sufficient written proof that you have designated them as your Authorized Agent and we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information.

NON-DISCRIMINATION

You have the right not to receive discriminatory treatment for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you products or services.
  • Charge you different prices or rates for product or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of product or services.
  • Suggest that you may receive a different price or rate for products or services or a different level or quality of product or services.
