Meta builds audiences based on your “seed” data—such as past purchasers, high Lifetime Value (LTV) customers, or website visitors.

Using standard advanced lookalike audiencing or smart bidding natively with patient data violates HIPAA because major ad platforms like Meta and Google explicitly refuse to sign a Business Associate Agreement (BAA). Under HIPAA, sharing Protected Health Information (PHI)—which includes patient lists, email addresses, IP addresses, or tracking pixels on medical pages—with a non-compliant third party for marketing is an illegal disclosure. 

Why Native Lookalikes and Smart Bidding Cause Violations

  • Lookalike Lists: Uploading a patient spreadsheet (names, emails, phone numbers) to Meta or Google to build a lookalike audience directly exposes PHI to a vendor without a BAA.
  • Tracking Pixels: Standard Meta Pixels or Google Tags installed on your website track user actions.
